TERMS OF SERVICE

DISCLAIMERI do not allow my art to be used for AI purposes and alike. Please do not upload my art to any AI sites as this could compromise my artwork.
NFT usage of my artwork is strictly forbidden.

USER AGREEMENTBy purchasing my services (art), you agree that you have read and accepted all the terms described herein. Please read these terms entirely and carefully. If you are not willing to agree to my Terms of Service, your commission will be refused.
You will agree here to the policy of using the art for personal, non-profit purposes unless otherwise agreed upon, and provide all image credits to me.
You understand that all commissions are priced individually. The final quote is decided by me, the Artist, and agreed upon before payment.
Transaction communication will be done through email unless otherwise agreed upon.If you have any questions, please contact me.

CLIENT• You, the Client, will be expected to first read my Terms Of Service and understand my general Commission Prices.
• You, the Client, are purchasing a "Digital Artwork". As such, nothing is ever intended by either party of this transaction, to be physically shipped.
• You, the Client, may display the commissioned Artwork on external sites as long as it is visibly credited to me.
• You may not upload or host my work in any gallery that is intended to display your own work only.
• You may not claim my work as your own.
• You may use the commissioned Artwork for personal use including, but not limited to: avatars, phone or computer wallpapers, and personal profile displays.
• You reserve the right to print or create an otherwise physical reproduction of the commissioned Artwork as long as it is for your PERSONAL use only (i.e. NOT for commercial use), unless otherwise agreed upon.
• You may not use the commissioned Artwork for redistribution or external projects, commercial or non-commercial (i.e. branding, t-shirts, mugs, public flyers, etc.), unless otherwise agreed upon.
• Any harassment in an attempt to bargain for a commission is not tolerated. This includes inappropriately worded comments on my profile, as well as private messages. I reserve the right to blacklist anyone over harassment.
• By placing an order, you agree to these terms and conditions. Please read these terms carefully.

ARTIST• By commissioning me, you are purchasing my service as an artist only.
• I reserve the right to post your finished artwork in my gallery for any reason.
• I reserve the right to decline any commission request or client for any reason.
• I reserve the right to refund you the full amount paid if I no longer wish to work on your commission for any reason.
• I do not do the following: R18, furry (anthro is okay), heavy gore, heavy horror or anything else that makes me uncomfortable.

COPYRIGHT• I reserve the right to sign and/or watermark my own work including both full resolution and any smaller resolution versions of my work.
• I retain all copyright over my work, which includes the right to redistribute, reproduce, or use the image as a sample for sales or self-promotion unless otherwise agreed upon. In the case of a commission, I will give proper credit to you as the Client unless you request to remain anonymous.
• I will not claim the rights to a character design unless it was one of my own designs. Therefore I will not resell the Artwork for commercial projects unless otherwise agreed upon.

NDA - PRIVACY REQUEST• If you wish for your request to be private until a certain date, it must be stated during the ordering process.
• I reserve the right to charge an NDA fee if I deem fit.
• The privacy request entails that I am not allowed to share any progress images on social media or stream the process of the commission anywhere until the appointed date. However, this also means that you must refrain from sharing any such spoilers yourself.

ORDERING• You can view my current commission status on my Commission Page and Trello.
• You may submit a commission inquiry via private message or email. This should include which commission option you want, reference images, a description, and a deadline if you have one.
• If I agree to accept the commission; I will ask you to resubmit your order via the email you would like the invoice to be addressed to (if it was not initially done so).
• It is your responsibility to ensure your order contains the details you want me to follow. To guarantee the total accuracy of your commission request, please make note of the required details and elements in the submission. Providing your own simple sketch is very helpful if you're unable to provide reference images of certain elements.
• I have the right to charge a complexity fee if your commission request is extremely detailed. This fee will be stated during the discussion of your commission price. You hold the right to adjust your commission request (e.g. remove certain elements, agree to simplified design changes) if you would like to lessen or avoid the complexity fee.
• I will - after everything is processed and confirmed - send you an invoice. You need to confirm the payment with me before I begin working on your commission.

PAYMENT• I will only accept USD as payment. You are responsible for making currency conversions.
• I will initiate the transaction to avoid accidental transactions. Do not send me any kind of payment until I have confirmed I can accept your commission, reached your spot in the queue, AND have asked for payment via invoice.
• I am not responsible for any mistakes that are made on your part over the course of the transaction.
• It is expected that you deposit 100% of the price upfront before I begin working on your commission. No exceptions.
• If payment is not made in a timely manner (24 hours) after I've placed the invoice, the commission will be canceled.
• Repeated counts of commissioning and failing to pay will result in blacklisting.

REFUNDS• I can refund 100% of the payment only if I have not started working on the sketch.
• Once I start the sketch there will be NO REFUNDS.
• If I cancel a commission, I will reimburse the lost fees and refund 100%.
• You are required to contact me when you need to cancel a commission request.
• You are NOT authorized to issue a chargeback for any reason.
• Purposefully issuing a chargeback without contacting me to cancel/refund a commission will result in immediate blacklisting.

SCHEDULING
• I work on commissions one at a time. Queue information is available on my Trello.
• You reserve the right to set a deadline for your commission. This deadline must be disclosed in your initial inquiry.
• I reserve the right to decline a commission if there is too short of a time allowance.
• I reserve the right to take at least 2 weeks to work on your commission; even if my estimated turnaround time is shorter.
• It is also the client's responsibility to ensure prompt communication. I will not be held responsible for late delivery if the client does not respond to my inquiries in a timely manner.
• Harassment over my work speed will not be tolerated.
• You reserve the right to be notified of any delays.

PROCESS• After 100% of the invoice has been paid, I will start working on your commission.
• I work in three stages: rough sketch, base coloring, and rendering.
• I will send you a progress image near the end of each stage to allow for review, feedback, and any revisions.
• Revisions are only available once per stage.
• These progress images will be provided in the form of .jpg or .png files.
• I will not be making major revisions (e.g. complete redesigns of major elements like composition, pose, outfit, props, extras, etc.). Nor will I increase the number of revisions for additional payment, so please be specific about what you want or allow for artistic liberty.
• Each time I send a progress image to a client, I ask the client to provide feedback to me. I am not responsible for any unsatisfactory element of the finished Artwork if proper details were not provided and/or no feedback was given to amend it.
• After the order is completed, minor revisions are allowed if the missing or inaccurate elements are my fault (e.g. I overlooked details provided in the order).
• The final image will be a .png file unless otherwise requested, and provided through Google Drive.

FINAL PRODUCT• There may be slight differences between the samples in my gallery and the illustration you will receive.
• The commissioner must respect that my artistic style cannot be altered.
• I reserve the right to reject critiques pertaining to artistic skill and stylization, and if the critique reduces the artistic quality of the piece.
• Credit to me, the Artist, is required when you post or use the commissioned Artwork on another platform.
• You, the Client, are responsible for saving any information, images, and other digital data I provide.
• Any file you paid for will be available from me for a finite time only. I take measures to preserve most files for up to 3 months. However, I cannot guarantee against computer failure or accidental deletion or loss.
• I am not required to post your commission in any public space, and if posted, I am not required to keep it there indefinitely. I have the right to delete or remove any public commission, even if you paid for it, as you should have your own copy for personal use.
• Feedback of the final product is permitted after completion of the piece, through private messages or comments.
• Any comments that are rude, inappropriate, inflammatory, and/or non-constructive may result in blacklisting.
